MASSACHUSETTS BACKGROUND SCREENING

Massachusetts background screening has a number of laws governing background checks, including employment background checks, housing background checks, and firearm background checks.

Employment Background Checks

Employers in Massachusetts are generally prohibited from asking about criminal history on job applications. This is known as the “ban the box” law. However, there are a few exceptions to this rule. For example, employers can ask about criminal history if the job involves working with children or vulnerable adults, or if the job requires a security clearance.

If an employer does conduct a background check, they must follow certain procedures. They must notify the applicant in writing that they will be conducting a background check, and they must provide the applicant with a copy of the report. The applicant has the right to dispute any inaccurate or outdated information in the report.

Housing Background Checks

Landlords in Massachusetts are generally prohibited from discriminating against tenants based on their criminal history. However, there are a few exceptions to this rule. For example, landlords can refuse to rent to tenants with certain types of convictions, such as convictions for violent crimes or drug trafficking.

If a landlord does conduct a background check, they must follow certain procedures. They must notify the applicant in writing that they will be conducting a background check, and they must provide the applicant with a copy of the report. The applicant has the right to dispute any inaccurate or outdated information in the report.

Firearm Background Checks

All firearms sales in Massachusetts must be conducted through a licensed dealer. The dealer is required to conduct a background check on the buyer through the National Instant Criminal Background Check System (NICS). The NICS is a federal database that contains records of criminal convictions and other disqualifying factors.

If the NICS returns a “no-sale” result, the dealer is prohibited from selling the firearm. The dealer must also notify the buyer of the denial.

Other Background Checks

In addition to employment, housing, and firearm background checks, Massachusetts law also allows for background checks in other contexts, such as adoption and volunteering. The specific requirements for these types of background checks vary depending on the context.
